These terms of use (“Terms of Use”) govern your submissions, content, and participation as a contributor to www.stephanieszostak.me/our-boob-stories (the “Website”). The Website is owned by Stephanie Szostak (“Owner”). Any content that you submit to the Website, whether it be pictures, stories, poems, or other content, are considered submissions (“Submission(s)”). Submission(s) will not be treated as confidential, but any personal information you choose to provide in connection with you Submission (i.e., full name and email address) will be treated in accordance with your preferences as outlined on the Submission(s) form, subject to age restrictions as outlined below. By using or accessing the Website, you are agreeing to be bound by these Terms of Use and to abide by and comply with the Terms of Use set forth herein.
You must be at least 13 years old to submit a Submission(s) to the Website. By using the Website, you state that you are (i) at least 18 years of age (or an emancipated minor) and are fully able and competent to enter into these Terms of Use; or (ii) at least 13 years of age and your legal parent or guardian consent to your Submission(s) and agree to be bound by these Terms of Use and shall provide signed written consent of same, which shall be submitted to sharestory@ourboobstories.com. If you are at least 18 years of age (or an emancipated minor), you will be able to choose how you would like to be credited in connection with your Submission(s) to the Website, including any other media (including book form) in which Owner chooses to exploit the Submission(s) at Owner’s sole discretion. You will be given the option to select any of the following credit preferences on the Submission(s) form: (i) Full Name, (ii) First Name, (iii) Initials, or (iv) Anonymous. If you are between the ages of 13 – 17, Owner will only credit you as Anonymous or by Initials in connection with your Submission(s); please select your preference on the Submission(s) form accordingly. In the event that we learn that we have collected a Submission(s) from a child under the age of 13, we will delete that information where reasonably possible. If you believe that we might have any information from or about a child under the age of 13, please send a detailed message to hello@ourboobstories.com.
You represent and warrant that (i) you exclusively own or have all the necessary licenses, rights, consents, and permissions to use, copy, edit, modify, and publish any Submission(s) or any part thereof that you submit to the Website as well as the right to grant the Website and Owner the right to do the same; (ii) your Submission(s) does not and will not infringe any trademark, copyright, moral right, right of publicity, right of privacy, or any other right of any other person or entity or violate any law or contractual duty.
You agree to defend, indemnify and hold the Website, Owner, and their respective affiliates harmless from and against any and all claims, damages, liabilities, losses or demands arising out of or in connection with (i) your use and access to the Website; (ii) your violation of these Terms of Use; (iii) any breach of your representations and warranties herein; and (iv) infringement of third-party rights (copyrights, trademark rights, personal rights, etc.) by you or your Submission(s). The indemnity obligation includes the reasonable costs of legal defense, in particular lawyer’s costs and fees, necessary to defend against such claims.
Your Submission(s) to the Website will remain your property. We do not claim ownership of any Submission(s). By submitting and uploading your Submission(s) to the Website, you grant the Website and Owner a perpetual, irrevocable, worldwide, non-exclusive, royalty-free, transferable license (with the right to sublicense) to host, store, use, display, reproduce, create derivative works of, modify, adapt, edit, rewrite, publish, and distribute your Submission(s) in connection with the Website and in other media including book form, and for any other purpose determined by Owner or Owner’s affiliates, partners and respective successors and assigns at Owner’s sole discretion, including for promoting, marketing, and redistributing part or all of the Submission(s) in any media now known or hereafter invented for all purposes permitted by law. To the extent permitted by applicable laws, you waive any moral rights or similar rights you may have in any of your Submission(s). You also understand that there is no guarantee that your Submission(s) will be reviewed, accepted, or published. Owner may access, review, select, and screen Submission(s) at Owner’s sole discretion, and Owner reserves the right to block, remove, or delete any Submission(s) at any time, with or without notice, and to limit or restrict access to any Submission(s), for any reason whatsoever, without liability and limitation.
These Terms of Use will be governed by and construed in accordance with the laws of the State of California. The Terms of Use may be updated from time to time and will prove binding upon you and your Submission(s) without advance notice being given to you of such updates. By making a submission to the Website, you acknowledge that you have agreed to be bound by these Terms of Use.
